A Chambersburg man was taken into police custody on a warrant Monday morning after, police say, he broke into a construction site and operated equipment last year.
Breon Darnell Oliver, 23, is charged with unauthorized use of motor vehicles, multiple counts of theft and trespassing, according to court documents.
On May 9, 2019, police were dispatched to 157 Lincoln Way East around 7 a.m. to speak with an unidentified individual regarding an incident in the construction area of the Franklin County Courthouse.
The owner of Lycoming Supply Company, who owns the construction equipment, is currently renovating the parking lot for the new courthouse project, according to police.
The parking lot is surrounded by a tall, chain-link fence with multiple "no trespassing" signs.
The owner told police the construction crew had left the worksite the previous day at about 5:30 p.m.
When the crew arrived at work around 6 the next morning, they noticed a key was missing out of one of the Bobcat machines. It was standard operating procedure to leave keys inside the machines overnight, the owner told police.
Additionally, the crew noticed that one of the excavator's buckets was lifted off the ground when the buckets were to be placed at ground level before leaving the worksite, according to court records.
Police reviewed the county's surveillance video that views the entire parking lot construction project.
Around 8:30 p.m. on May 8, 2019, the video footage showed a person, now identified as Oliver, climbing over the fence that was in place to keep people out of the area.
Oliver then walked toward the Bobcat machine, sat in the seat and fumbled with the keys, according to police. The vehicle was "unlawfully taken" by the defendant, court documents state.
The defendant also drove a mini excavator in reverse and continued to operate two other large excavators on the site before climbing back over the fence.
Oliver was later arrested at the Chambersburg Aquatic Center for a separate incident, according to court documents.
During an interview, police say Oliver admitted to being responsible for the incident at the construction site.
Oliver was released without bail.
He is scheduled to appear before Magisterial District Judge Kelly Rock for a preliminary hearing on March 31.
